Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of the SymphonicBail platform, operated by TapCorp, LLC ("SymphonicBail," "we," "us"). By accessing or using the service, you agree to these Terms. If you are using the service on behalf of an organization, you represent that you are authorized to bind that organization.
2. The service
SymphonicBail is a business platform that licensed bail-bond agencies use to manage clients, write bonds, process payments, track court dates and forfeitures, generate documents, and produce reports. Features evolve; some are in active development and may change.
3. Eligibility
The service is intended for licensed bail-bond professionals and their authorized staff, for legitimate business use. You are responsible for maintaining any licenses, appointments and authorizations your jurisdiction requires, and for complying with all laws and regulations applicable to your business.
4. Accounts & security
You are responsible for the activity under your account and for keeping credentials confidential. Notify us promptly of any unauthorized use. We may suspend access to protect the service or its users.
5. Your data & responsibilities
You retain ownership of the data you enter ("Customer Data"). You grant us a limited license to host and process it solely to provide the service. You are responsible for the accuracy and lawfulness of Customer Data and, in particular:
- for having a lawful basis to collect and process information about the people you manage (defendants, indemnitors and references); and
- for obtaining and maintaining any required consent before contacting those people — including consent to send text-message and email reminders — and for honoring opt-outs. The platform provides consent tracking and one-tap opt-out tools to support this, but the underlying consent is yours to obtain and stand behind.
6. Not legal advice
SymphonicBail is an operational tool, not a law firm and not a provider of legal advice. Jurisdiction rules, premium and fee calculations, computed deadlines, and generated documents are research-based aids and drafts. They are not counsel-reviewed unless explicitly marked as such, may not reflect the most current law, and must be independently verified. Generated legal and regulatory documents are attorney-reviewable drafts, not filings. You are responsible for reviewing, verifying, and properly filing or serving anything produced through the platform, and for consulting qualified counsel where appropriate.
7. Acceptable use
You agree not to: use the service unlawfully; upload another person's data without authority; send unsolicited or non-consented messages; attempt to breach security or tenant isolation; reverse engineer or disrupt the service; or use it to harass or harm any person.
8. Third-party accounts & services
The platform can connect to third-party services you bring — such as your own payment processor, e-signature provider, or email account. Your use of those services is governed by their own terms, and we are not responsible for them. You authorize us to act on your behalf with those services as needed to provide the connected features.
9. Fees
Pricing, plans, and any usage-based charges (for example, message volume) will be described at or before the time they apply. During early access, fee terms may be communicated separately. Fees, once applicable, are due as agreed and are non-refundable except where required by law.
10. Intellectual property
The platform, including its software, design, and content (excluding Customer Data), is owned by TapCorp, LLC and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the service while these Terms are in effect.
11. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any computed value or generated document is accurate or compliant for your jurisdiction.
12. Limitation of liability
To the fullest extent permitted by law, SymphonicBail and TapCorp, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service will not exceed the amounts you paid us for the service in the twelve months before the claim.
13. Term & termination
These Terms apply while you use the service. You may stop using it at any time. We may suspend or terminate access for breach or to protect the service. On termination, you may request export of your Customer Data, subject to legal retention requirements; we may then delete or retain it as required by law.
14. Changes
We may update these Terms as the product evolves and will revise the "last updated" date. Material changes will be communicated to account holders; continued use after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State in which TapCorp, LLC is organized, without regard to conflict-of-laws rules. (Specific venue and dispute-resolution terms to be finalized by counsel.)
